1. Agreement and eligibility

By accessing or using Bitesurge’s mobile application, websites, restaurant or creator tools, and related services (the “Services”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. You must be legally able to enter into this agreement and meet any age requirements that apply where you live.

2. Accounts

You are responsible for providing accurate information, safeguarding your credentials, and activity under your account. Notify support@bitesurge.com promptly if you suspect unauthorized access. You may not sell, transfer, impersonate, or create accounts through unauthorized automated means.

3. Restaurant information, orders, and payments

Restaurants are responsible for their menu information, ingredients, availability, preparation, fulfillment, and food safety. Prices, taxes, fees, pickup estimates, acceptance, cancellations, substitutions, and refunds may depend on the restaurant, payment status, and applicable law.

Payments may be processed by third-party payment providers. You authorize applicable charges presented at checkout. Do not rely on Bitesurge as a substitute for speaking directly with a restaurant about severe allergies or dietary requirements.

4. User and creator content

You retain ownership of content you submit. You grant Bitesurge a non-exclusive, worldwide, royalty-free license to host, process, reproduce, adapt for technical display, distribute, publicly display, and promote that content in connection with operating and marketing the Services. This license ends when content is deleted, except where continued retention is technically necessary, legally required, or the content has been shared and remains part of another user’s permitted activity.

You must own or have permission to use submitted content, obtain appropriate consent from recognizable people, and avoid private, unlawful, misleading, infringing, or harmful material. Publication is not guaranteed. Bitesurge and authorized restaurants may review, reject, restrict, or remove content.

5. Creator attribution and compensation

When offered, an eligible approved creator video may be attributed to a qualifying item purchase. The applicable earning rate, holding period, minimum payout balance, and eligibility criteria are shown in the Services or creator program materials. Self-purchases, fraudulent activity, duplicate attribution, ineligible orders, refunds, disputes, chargebacks, and later content invalidation may reduce, hold, reverse, or offset earnings.

Payout eligibility requires completion of applicable identity, bank, and tax onboarding with our payment provider. The provider controls its verification and bank-payout timing and may request additional information.

6. Acceptable use

You agree to follow our Community Guidelines. You may not attempt unauthorized access, interfere with operation, scrape or reverse engineer the Services except where law permits, manipulate engagement or attribution, deceive others, violate intellectual property or privacy rights, or use the Services for unlawful or harmful activity.

7. Availability, suspension, and changes

We may add, modify, suspend, or discontinue features. We may limit or suspend access to protect users, restaurants, Bitesurge, or others; enforce these Terms; investigate suspected abuse; or comply with law. We may terminate accounts for material or repeated violations.

8. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Bitesurge is not responsible for restaurant acts or omissions, food preparation, off-platform conduct, or third-party services.

To the fullest extent permitted by law, Bitesurge will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Changes and general terms

We may update these Terms and will post the revised version with a new date. Continued use after the effective date means you accept the updated Terms. If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
