1. Scope
This Privacy Policy applies to the Bitesurge mobile application, websites, restaurant and creator tools, customer support, and related services (collectively, the “Services”). Bitesurge is based in Atlanta, Georgia, United States.
2. Information we process
Information you provide
We may process account details, contact information, profile content, delivery or pickup details, comments, Party invitations and votes, saved items, order information, restaurant information, support communications, and videos or other content you submit.
Payments and creator onboarding
Payments and eligible creator payouts are processed by payment providers such as Stripe. They may collect payment card, identity, bank, or tax information directly. Bitesurge receives transaction references, connected-account identifiers, payment status, and limited details needed to operate and support the Services; we do not store complete payment card numbers.
Location, device, and usage information
With your permission, we may process location to show nearby restaurants and dishes. We may also process device identifiers, push notification tokens, app version, diagnostic data, interactions, search activity, and security logs.
3. How we use information
We use information to:
- Create and secure accounts;
- Provide dish and restaurant discovery, Parties, saved items, carts, orders, and support;
- Process payments, attribute eligible purchases, calculate creator earnings, and handle refunds or disputes;
- Moderate content, enforce our terms, prevent fraud, and protect users and the Services;
- Send transactional email and push notifications;
- Understand performance and improve reliability, relevance, and product design; and
- Comply with law and establish, exercise, or defend legal claims.
5. Public and community content
Your chosen profile details, approved creator media, reviews, comments, and associated creator attribution may be visible to other users or restaurant partners. Avoid posting information you do not want others to see. Reporting and blocking tools may be provided to manage community interactions.
6. Retention and deletion
We retain information for as long as reasonably necessary to provide the Services, comply with law, resolve disputes, prevent abuse, and maintain financial and security records. You may request account deletion in the app or through our web deletion resource. Public profile and creator content associated with a deleted account will be removed or de-identified, subject to backups and legally required retention.
Transaction, commission, payout, tax, dispute, fraud-prevention, and security records may be retained after account deletion where necessary or required.
7. Your choices
You can choose whether to grant location, camera, photo library, and notification permissions through your device settings. Depending on where you live, you may have rights to access, correct, delete, or receive a copy of certain personal information, or to object to or restrict certain processing.
To make a privacy request, email privacy@bitesurge.com. We may need to verify your identity before completing the request.
8. Children
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, contact us so we can investigate and take appropriate action.
9. Security and international processing
We use administrative, technical, and organizational safeguards designed to protect information. No system can guarantee absolute security. Information may be processed in the United States and other places where our providers operate, subject to applicable legal protections.
10. Changes to this policy
We may update this policy as the Services evolve. We will post the updated version here and revise the “Last updated” date. If required, we will provide additional notice.
